You can have it stated but not worth the paper it's printed on if it contradicts the law like that article Posted. It's like those management accept no responsibility signs load of rubbish you can not negate liability for someone on your premises.

All be very carefull , many people are now clued up to the law , if you start a job and put materials into it on somebodys property you have no way of getting them back or getting paid if they pick fault. If you enter the property and try , they can call the police and you will be arrested for criminal damage.The police will telll you it is a civil matter and you must claim at court.We got tricked last year, we were asked to del a full load of stone to an address in Chertsey , our truck arrived and backed into the property and unloaded. The customer asked the driver to pull out on to the road so he could lock his gates and he would then pay him in cash. He pulled out side and the customer locked the gates and drove off without paying.We called the police and they came out to investigate but they told my driver basically we were wasting our time and would never get paid because they will deny anything to do with it. Lost nearly £1500, we learnt our lesson and will not unload until payment has been made.

If you have a signed contract and take them to court you will win your case ... Simple.... you can even claim under verbal contract

So if I manage to find his home address and spend god knows how much on solicitors fees and he gets to pay me back at £1 aweek cos he says he got no money and that leaves me even worse off.

In my mind it is not worth the stress or hassle.

I hate to admit it but I will just have to put this down to being stupid and move on. :angry: :(

I just hope that telling you all saves any of you from the same fate.

I would move on Injured because you could end up spending a lot of money fighting a lost cause

20 years ago I took 2 customers to court and won hands down, I had charging orders placed on their houses so you think your money is in the bag at some time in the near future

when the houses got reposesed I was 4th in the pecking order for getting a payment, there was not enough money in the pot to pay the first 3 let alone me so i ended up with nothing off either of them, it cost over £2,000 to take them to court

there was no doubt about the skill and speed at which my solicitor acted on all the cases I used him for but it certainly came at a price what hits the pocket as he charged £140 an hour in 1987, I did not earn that in a day let alone paying it out by the hour

In 1987 I issued a winding up order against a large and well known PLC company as I was owed over 32k for construction work, 15 months later i got paid the final payment but it leaves a bitter taste in your mouth when a large corporation tries to squash the little guy, thats when I decided while I was lay in bed assessing the situation and how am I going to be able to put beans on my toast for tomorrow night evening meal never to do anything commercial again and to this day I have only ever worked on domestic property and always dealing with the home owner direct

by changing the way I generate my work I have never had any bad debt for the last 20 years and personally thats how its got to be, I'm not trying to tell anyone how to suck eggs here just saying that you need to be on your guard against the possibility of someone taking your hard earned money from you

We did a big job putting in all the concrete pads and bolts for a new steel stand at a premier rugby club, we knew the committee at the club but worked for the steel company.

They were a nightmare on payment, quibbled every placement and alignment and held off payment for months blaming the club, despite us being shown the paid invoices by the club. Eventually got paid but was a real learning curve. Good on you mick.

Recall something about the law and if you build on someones land, it becomes thier property automatically?

Alternatively , you could always do what THIS guy did. Not very clever, but 100% on the satisfaction scale :)

There are some real shits out there.

We've been burnt a few times quite recently and it drives you up the wall. The chances of getting any money out of this guy are slim to zero, and also you say he may be involved with some pikies. Bottom line is he is a criminal and I would avoid him like the plauge and just take the hit.
