Highways pothole - Damage to car

cut a long story short, the missus wrote off a tyre and front alloy in our car on a pothole in september last year. Cost us about £300 with the tracking (which was out by 5mm)
Anyway, fill in an online claim against highways. they filled the hole next day. After three months of chasing, they said they would not pay as "they cannot be expected to be responsible for every fault".
They asked how many times i use the road, and i said at least once a day (to/ from yard)
They said it was negligence on my half for not reporting the pothole to them sooner!
I am considering a small claims court case against them.
Anyone have any thoughts on this? or am i wasting my time and money?

i ruined a 17inch alloy on my pug 306 dturbo as a 18 yr old went back photographed the pot hole with a ruler in it showing a 6 inch deep pot hole by 12' wide and 24' long, spent 2 months trying to claim gave up in the end. the hassle and stress wasn't worth it. still got a set of allows with news tyres that are useless because one is fubared

i hit one 9 inches deep near slip end DDD blew out 2 tyres ,i suppose the 4 other cars sitting there with punctures should have been a tip
chased it for 2 years and got nothing,they kept passing the buck between different people
i asked for a refund of my road tax fund ,but its big brother time :(

2 years ago a mate of mine bent a rangerover alloy 800 quid wheel,they would not pay out as hole was not reported, but before that he did another one few miles up road thay paid out as it was reported and not fixed......wheres the logic thats norfolk CC for you........... :(

seems that the road tax is a waste of time then eh?

I am waiting to hear back on someone else who managed to get money out of them.

seems others have had the same thing. small claims cost £50. forces one of their bods to turn up. if they don't, they lose :;):
