ive got a customer who wants a new fence at the mo she has the bad side the neighbour isnt interested in paying a penny so can she have the nice side as shes paying the lot ?

how do you mean she has the bad side now?. if shes paying the choise is hers

Sometimes the deeds will specify which way the fence should be round if both parties are responsible for it.
If she is paying for it herself then she may want to consider moving it so the fence is on her land rather than right on the boundary. Then she can do whatever she wants with the fence and hit the neighbours with criminal damage if they try to paint the other side etc.

i am pretty sure that the same with walls and piers etc ,that the post and rail side must face the owners property
I wouldn't move the fence as after 7 years up a fence becomes the boundary,party wall surveyor told me this
having said all that I would normally go with the customer's wishes
