Newly resurfaced drive - Porous surface

Just had in the last few days our drive resurfaced with tarmac cover of approximately 80mm. We have now found to our surprise that rainwater soaks through this new tarmac and runs on the old surface underneath, eventually coming through to the surface again at the bottom of the drive. The slope is approximately 20 degrees. Our well known local professional company says all has been done to the correct specification but surely water should not penetrate the new tarmac. Any advise would be greatly appreciated.

We need more info - 80mm of what? Base and surface course? What is the surface course?
