Hi guys, I have an appointment with a client in the morning with regards to the possibility of a new driveway. Now this will be the first since this new legislation has come in but i'm still a little confused over where we stand. I have spoken to a friend who is on the marshalls register and as far as he is concerned the new rules dont apply in Scotland although i keep finding conflicting info across the web. Any clarity on the situation would be brilliant. Many thanks. Sam

I'm pretty sure that the regs do not apply to Scotland and N/Ireland. You would be best to phone the local council though and confirm that but my brother is a planner in Edinburgh and whilst they are thinking about it they have not even drafted legislation yet.

Because we (England,scotland,wales) are all classed as Great Britain it is only England whom the law applies to AFIAK which makes perfect sense as We are an easy pushover and have different laws to different countries when its convienient.
Which is nice.

The comedy Front Garden Paving legislation of last October applies ONLY to England. Scotland is a bit more complicated as there are requirements under SEPA for commercial projects but, as I understand it, residential driveways are exempt, except for certain areas where the local authority may use a by-law to control run-off.
I have a pal who knows just what is and what isn't possible under the current legislation in Scotland, so I'll see if i can get a definitive statement from him tomorrow. Too late to pester him tonight!
