Stick with the hired one till they pay out, should help speed up the process massivly. Make sure they know thats what you are doing.

I suspect his neck is alright. It will the psychosocially effects, the nightmares, in ability to work due to fear of it happening again, can't drive a digger off the ramps without panic attacks, never mind the damage to the digger, trailer, loss of earnings etc. Still might be able to keep the van as part of the claim, bolt the door shut and stik a new head light in.

That'll repair easily. I'd try and keep the truck.

Something similar happened to one of my Tranny vans a few years back (when I was still contracting). We were working in Ormskirk about 25 miles from home, so I drove it back at the end of the shift and wouldn't you know it, a Plod in the nearby big town where I had to drop off some of the lads decided to nab me. This particular Plod had a grudge against us: my vans and wagons had been pulled over at least 15 times in a 6 month period and I ended up filing an harassment clainm against him and his force.
Anyway, despite the accident being no fault of mine or anyone working for me, and the only real damage being a smashed headlight/indicator assembly, I was charged with "driving a vehicle in a dangerous and unroadworthy condition" even though it was 5:30pm on an glorious August day, so no lighting issues. I took it to court, it was thrown out by the magistrates and the Plod reprimanded for wasting the court's time. Still, it cost me a day off work and another dollop of stress.
So, the moral is to be careful if you have to drive a vehicle with a missing headlight.
