well i went with the mrs to buy a tv and asked are they new and what they can do as i dont know much about tv"s

i was told its new just in a tatty box so i purchased the tv and also bought a wall bracket.

when i got home and set the tv up it just seamed bits was missing no registration for the warrenty no batterys for the remote and all the bags inside had been opened, even the instruction book had some random writing on it.

i decided i was not happy and went to my receipt to get the number of the store, and it was at this time i noticed the salesman had written "graded" on the receipt.

when i called the store was closed so i emailed them but got no reply by monday afternoon, so i called them explained the situation and was told they would exchange it for a new one.

i said i was not happy and wanted nothing more or less than a full refund under my statutory rights as a shopper as the tv was not as descibed as it was sold to me as new when it was not.

they say they will not give a refund only an exchange for a new one...


i dont want to do any buisness with this company and wish to have my money back and i suppose i will have to go to the small claims court to get this.

i think i will have to go with the tv to the store on saturday to see what happens but i cant see them shifting on this..


any help or suggestions please...

i have emailed panasonic with the seriel number to see if its been registered already by some one.. waiting for a response..

I'm taking a dodgy van dealer to court at the minute.
Where did you get it from? was it in the clearance section?

Sorry guys I do not wish to name the store at present as I need to try and get this sorted, once I do I'm happy to name them.

I am suppose to be going to the store Saturday to exchange it for a new one, am I being fare with expecting the new one to be in a security sealed carton?

I ask this as when I called the store the guy on the end of the phone was adamant that the one I have is brand new and not a graded item, with all the packing open and the writing on the instruction book I don't beleave it is and am very concerned they will just put another one in a box and tape it all up to make it look like new.

Goods were not of satisfactory quality as described. You're not necessarily entitled to a full refund if they can fix the problem which is in this case replacing the goods with brand new.

If they're f*cking you about then keep a diary and log of everything you have done and conversations, it's handy for if you go to court. If you do go to court you can do it online, small claims court for £30 or something.

I bought a 52 inch bravia that had been graded in 2010,but i got it £500 cheaper

As been said, they are not duty bound to give you a refund. If the TV had been faulty within a few days of purchase,you would be entitled to an exchange or refund.

Graded goods are normally discounted, was your TV discounted? As they have offered to replace the TV for a new one, personally I'd go for that. If they refuse to refund your money and you take them to the small claims court you need to consider that you accepted the T.V in used packaging and on the receipt it states that it is graded. Unfortunatly the judge will only go by factual info and not hear say,they have also offered to replace the TV with a new one which will also go on thier side.

Mmm me and my mrs went to the store and was told its new just in a tatty box, for £25 more I can get the next model up from tesco direct, I decided to shop local and feel I've been ripped of.

Don't worry once I do have this sorted out I will inform everyone how it was sorted
And who they are

It's not comet or cash converters or a pawn shop

I really need to get this resolved, and I don't want them saying I've been slating them and all that, as I think I may need to take legal action in the end.
