Hi,

I'e just spent over 3K on a new tarmac driveway and new gate pillars/gates. My neighbours garden is higher than mine and is draining through my boundry wall and onto my new drievway and underneath one of the pillars.

I have contacted the water board and they have tested my drains and water pipes - they are fine.(the water board guy called into my neighbours but he was out!) They asked me to ask my neighbour to put some drain tracing dye down his toilet. He refused and was very evasive and downright uncooperative.

The running across the drive is water is clean and runs constantly. I think that it is from the supply feed to next door.

Over time it will undermine both the gate pillar and the tarmac drive.

Do the water board have any powers to force my neighbour to have this repaired and what rights do I have?

The water board don't, but your local Environmental Health Department might be able to intervene, and, if him-next-door continues to be unhelpful, you could bring in the <spit>solicitors and threaten legal action, because water emanating from his property is noticeably damaging yours. It's also worth contacting whoever holds your mortgage - they don't normally take kindly to anything affecting "their" property and might be able to advise on how best to proceed.
