The edging is lower than the driveway. - Is there a problem with our driveway ?

We need advise:
Our block paving driveway is nearing completion, the only remain thing to be done is to sand inbetween the block paving. One thing that concerns us is that we have noted in several places the outer free edging (soldier edge course) of the driveway is visiably lower than the main part of the drive.(while driveway looks very good).
We were saving for this driveway for 2,5 years, and we do not want to have any problem in the future.
What sort of problems can we expect in the future ? Is this something that our contractor can easily resolve ?
What recourse do I have if the contractor is Marshall registered and refuses to correct the defect satisfactorily?
any advise welcome...thanks

The edge will be lower if it was laid on concrete bed, to allow for final compaction of the blocks making it flush, till this is done and not untill then can you see if there is a problem, as for the payment you don't pay till its to your satisfaction, MSH :)
