Mot type one - miss sold?

Can any one point me in the right dircection for the spec for grading MOT
I have had a delivery which is not graded very well Some of the stone are 70mm plus
While it alo has a lot of fine material which leave brown clay like coating on your hand when you rub it in your palm
The builders material merchant is adamant it is MOT type 1
But I have already have had a batch from another supplier and thiis is nothing like it

type 1 is 40mm down, limestone,granite,
paving, mini-crusher, mini-digger hire and groundwork

Hi all
Thanks for your responses. Pablo I had another look and while some stones are quite oblong in shape being 70mm+ and would pass through the 40mm sieve there are still some stones that are 40mm in two directions and should not be in a mot type 1.
I've learnt a lesson that its best to look at the stuff before ordering. I guess the its OK for a domestic drive?

Grading envelope for DTp1
70mm stuff immediately rules it out of being Type 1
The BM should be able to provide a delivery note attesting to the product, and from where they sourced it. Mention the magic words "Trading Standards" and watch their attitude change!

Thanks for your advice Tony
I contacted West Midlands Trading Standards
They advised me to send a letter recorded delivery requesting evidence that the material is mot tp1
I've reluctantly decided to let the matter drop but what amazes me is this family have been in business for years passing this crap off as mot
